I like to know your experience with Perm for job zone V and ad in paper.
Which one you think will go through easier without the audit.
Our company attorney says master+0 will work. But I am thinking to require some experience will get better chance. I have master with 2 years before joining this company.
Please advice. I appreciate it.

You would require copy of the approval notice of 140 from the old company.
In the new company, you would need to file a new labor via PERM. Once it is approved, you would need to file a new 140 and use the copy of the old approved 140 to port your priority date.

I'm on currently on H1b (NO EAD). I'm applying for another job with a different company and came across the below question in thier Job Application. I don't know if the other company is willing to transfer my H1, but I would like to apply and prove myself in the interview.
If hired, can you submit verification of your legal right to work in the U.S.?
Should the answer be YES or NO? Can my current H1 be used as a proof of legal right to work???
I'm also required to acknowledge the below statement as part of the application.
I am aware that, as a condition of employment, if employment is offered, I must be authorized to work in the U.S. and demonstrate that authorization as required by the Immigration Reform and Control Act of 1986.
Appreciate if anyone of you can clarify this.

I am going to complete my 6th year on H-1b, this year end. My I 140 is cleared and I am going to file for 3 years extension. In the beginning of this year, for 3 months pay stubs are not run, due to some personal reasons. Will this affect my renewal of H1. We need to submit 3 pay stubs, before applying for extension. There will be a shortfall of YTD, when compared to actual. Please share your thoughts, who have clear understanding on these. thanking you.

I am in the same boat. Filed July 19th . As of Last Friday not in the system.
No checks cleared. All the guys who filed with me got their receipt last week from Texas. I am the only one remaining. My I140 was approved from NSC.

Mail it in, if it's rejected you do not lose anything. According to the law (8 USC 1255) the USCIS should accept it.
Not according to this:
8 1255. Adjustment of status of nonimmigrant to that of person admitted for permanent residence.
(a) Status as person admitted for permanent residence on application and eligibility for immigrant visa
The status of an alien who was inspected and admitted or paroled into the United States may be adjusted by the Attorney General, in his discretion and under such regulations as he may prescribe, to that of an alien lawfully admitted for permanent residence if

Remember to point it out at FP, and they will also ask you to phone USCIS and correct it. You could phone USCIS first, and then you might find that FP has it already corrected in the computer.
Once USCIS update it they will send you a letter to say that they made a change to the file, this is just FYI.
My wife's DoB had a typo. It was spotted at FP office.
Of course I am assuming some obvious typo, not a FP notice for Jim Smith and your name is Ramkrishnan Singh. :-)

tanyas_21: Amendment processing time is same as normal H1 processing time. Your status is H4 until the H1B amendment (797 w/ I-94) is approved or You re-enter USA after you get your H1B stamped. USCIS usually sends cable to home consulate mentioned in I-129 about the approval of H1B - It is one of the reason, most of the attorneys' recommend people to get it stamped from home consulate. As long as you go with all the paper work, You can get it stamped from Mexico, and I dont see any issues. Do not attempt to get it stamped from Canada unless you have a verifiable US education. No, you don't have to apply for a new H1 if the previous company did cancel your H1 and the H1 has not expired. A dormant H1 can be reactivated at any time.

My wife has FP appointment scheduled for 12/29/07, She is in india now. I have returned from india today only(12/28) and saw the FP appointment. Can i reschedule FP one day before the appointment date? If i send the reschedule request today will USCIS accept it? since there is only one day left. Please advice me.
