    Hello,

    My labor got approved couple days ago and my employer would like to file I-140 without using an attorney. I have few questions, it might seem simple to you but I am confused:

    I am a software engineer and labor approved for SOC 15-1032, what should be filled in the nontechnical description of job field? For H1B, my company listed duties of the position on the cover letter for this question, should it be the same way for I-140?

    Anyone has sample template of the cover letter?


    My company has not filed tax returns for the last quarter, will the returns of second last quarter do? I have W-2 which is substantially higher than the proffered wage.
    Since I am earning more than the proffered wage should that be filled under "wages" on I-140 or the offered wage mentioned on perm?

    Hi All,

    I transferred my H1B from Company A to Company B. Currently i am working with Company B, but my Company -B's H1B Application is Still in Pending.

    Now i would like to do the COS from Company B(pending H1B) to F1 as I already received I-20 from the University for the Spring 2010.

    Case Description: Assume that, we applied Change of Status from H1B to F1 and it is in pending status.
    Case i : what happens to my Pending H1B Application with the Company B.
    Case ii : What happens if my H1B with Company B gets approved/Denied, when COS from H1B to F1 is pending.
    Case iii: what happens if my H1B to F1 Change of Status gets denied.

    Gurus,
    I am planning to schedule a visa appointment soon. I was filling DS-156 form
    and have a following question:

    Item#36 : "Has anyone ever filed an immigrant visa petition on your Behalf?".

    Here is my situation:
    ==============
    Myself -> H1B
    My wife, kid -> H4

    Applied for I-485 last year ( all 3 of us ).

    Question:

    For me, I understand that I say "yes" and mention name of my employer.
    But for my wife+kid, I say "yes", but what should I fill for "who" part?

    Also, Item#33 for my kid (2nd grade), should answer to "Do you intend to study
    in US" be YES or NO ? ( my guess is YES, and name of the elementary school?)

    Hi,
    I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

    If the position is available and you have master's degree, yes your employer can start PERM process.;)

    I moved from Company A to company B towards the end of my H1 6 th year with only a month and half left in my H1. Company B applied for my 140 and 140 was approved just on the day of my 6 year completion. H1 transfer was filed in parallel in normal processing. H1 transfer has got an RFE now a day after 140 was approved.

    1. Will there be any problems in getting the H1 transfer based on the 140 approval with the new company? Please note that I do not have any days left in my original H1.

    2. What will the duration of H1 if the transfer gets approved?

    3. I am continuing to work based on 140 approval and pending h1 transfer. Please advice is it is ok.

    Got an RFE to produce employment verification letter from my current employer. Yes, i changed the employer recently but didn't file AC-21.

    Do you know how long USCIS takes to update the status online?

    I am assuming that your lawyer sent it by some means that can verify that it was delivered.

    USCIS usually takes about 7-10 days to update it online. (for example, if your RFE response was delivered to USCIS on Aug 10, expect it to be updated around Aug 17-20).

    If you do not see update after 15 days of the delivery of the RFE response, call USCIS customer service so they can track it for you.

    Requiring experience in addition to MS degree is considered "normal" for positions in Job Zone V. Whether it's more likely to trigger an audit or not - I doubt anybody will be able to tell you. For that somebody has to have experience of filing two PERMS, almost identical except for the experience requirement. I doubt many people have such an experience

    Guys,

    My wife was working on H1B now and she got EAD last week. Out of the following options which is TRUE and which is BETTER.

    Option 1--> Moving to EAD from H1B by signing on I-9
    Option 2--> COS from H1 to H4 and then to EAD.

    I read in some of our threads that if we choose option 1 and if something goes wrong in AOS, we have to file for new H1B again. We have to wait for quota etc etc.

    I also read that if we choose Option 2, if something goes wrong in EAD, we can always change back [ie RESUME]to H1B.

    I am not so sure about these. Could some one share their thought.

    A good friend of mine is getting divorced with her husband. The husband is the primary employment based green card applicant and their dates are current.
    Will her I-485 be denied after the divorce?
    The husband is willing to wait till the green card is approved before the divorce.
    If she gets her green card, will it be revoked after the divorce?

    is a continuation of medical benefits after you terminate your employment (voluntarily or involuntarily). It has nothing to do with immigration. The cost will be higher.

    If you are out of a job on H1B for a long time, then there certainly is a legal problem unrelated to COBRA. For EAD, it does not matter.
