My fiance who works now in OPT status has just got his fisrt-time H1 approval and will be travelling to India for our wedding in August. Is it possible beforehand to make an appointment together for our respective H1/H4 a week after the wedding? Thanks for your time!

you can use OCT 02 EB3, file I-140, after it is approved you can port the Oct 02 PD for the EB2 application too. This way you will be current as soon as I-140 is approved, guaranteeed.
EB2 will never go behing Oct 02.

Guys,
I don't know if here is right place to post this or not. I responded to RFE about 30 days ago and got an email update that TSC has got my response and the case processing is resumed. That was 485 and TB skin test that I had to do again.
Anyone has any idea what is normal time after response to RFE? I am EB3 with PD of Oct, 2003.
Do you recemmend me to call service center or go for infopass?

I have not heard any schedule for these bills. There was a hearing last week, but I couldn't find the outcome of the full hearing. May be someone from IV Core can tell us what is scheduled for the coming days.

I last entered in US using AP and currently working on EAD . My H1 is going to expire in April 2010. I am thinking of renewing it to provide a backup in case anything happens to my 485. I have to go to India in July 2010 and I would like to come back using AP. Pleass let me know which of the following option is best for me.
1. Renew my H1 now and go to India n July and come back using AP.I understand that in this case, if I have to use H1, I would have to go to India and get it stamped.
2. Come back from India in July and renew my H1 after I come back. Is this possible to renew the H1 after it expires and do they give you a I94 in this case?
Please let me know what you think. I need to decide ASAP.

I have a friend in India who applied to a new H1B through a consultant, was lucky to get through the lottery but is now stuck in RFE because of issues with the consultant. He heard from someone else that the same consultant is getting rejects and is nervous that his case will get rejected too.
I've heard that while a H1B case is pending (before it is denied), one can apply a separate petition from another employer and is still considered a valid application that is within the quota as it is for the same applicant.
Does anyone have experience in this area? What do you recommend? I also plan to contact an attorney regarding this to help my friend.

I am almost at the same situation.I have been here for since July 2000.Instead of getting married for american citizen I decided to go the long way.I have been changing visas from B2-H2b-F1 and now recently I apply with I140/I485.After having Masters degree in civil engineering from my country I went to school to become a nurse.After 3 years and many school I did finished and I passed the National exam for nurses but just when I was about to file for Schedule A the visa number finished and there was no chance of getting new once.Thank god they open the EB3 in July,or so I was thinking.USCIS did not separated my I140 from I 485 so I had no answer for 5.5 months.Only after I ask senators for help the thigs started moving.Finnaly I got my EAD and I can go back to saving life,which by the way I love.My advice is to marry US citized ASAP.Will save you a lot of trouble and if you love that person even better.;)

If she is currently on F-1 and if she wants to maintain F-1 when she comes back she will need to go to the embassy and get her F-1 visa. If she enters U.S on old unexpired H4-Visa her F-1 visa becomes invalidated and she won't qualify for OPT/CPT etc.

The process is similar to what one would follow for the regular H1B's. Starts with filing the prevailing wage determination with the labor dept and then filing the I-129 papers with USCIS. The only difference would be the fee, non-profit organizations don't have to pay something like a training fee, (I am not sure). You can file it anytime and start working as soon as you have the receipt number.

Is there anyway we could include EB immigration relief in the Economic Stumilus Package by bringing up creative pointers such as more greencards, more = small businesses, more greencards = more home buyers etcetera ? I see a faint chance here. With the urgency to kick start the economy, if we can get something on the bill, it will pass and will become a law fast.

It will take 10 minutes of your time (as IV has provided various templates you can use, you don't have to write anything, just insert your information where appropriate) and $0.82 in cost (for stamps). This is one way we can all help ourselves.

Hi, this is my first time in the forum and I wish to seek advice on my situation.
I'm a green card holder (singapore citizen) who got married while being a US PR. I wish to apply for my wife (singapore citizen) a green card.
How long is the typical wait? while applying, is it true that my wife can't enter the US?
I kind of know the answers but would like to confirm with this forum. I know the situation can be pretty bleak.

USCIS denied my and my family's 485 based on withdrawl of old pending 140.
How did you come to know about your denial. Did they send a denial notice after you applied for EAD. Was there any status change on the USCIS website after your 140 was revoked by employer.

I got a soft lud back in December on my approved 140 on a Sunday (along with several other IV members)... but nothing since then!
