Hello,

It seems that I made a mistake in my DS-160 and my H1B got stamped with an error in my middle name. I repeated my lastname as my middle name so my full name appears as: 1stName 1stLASTNAME 1stLASTNAME 2ndLastname

I have a Tourist Visa also stamped wich is OK. Also the data on my passport.

My I797 is OK and everything else is OK.

I am still in my home country. Should I be worried about it? Should I try change it here or in the US?

In any event, what's the correct procedure to change it?

Gurus,

In 2007 , I joined a new company and filed my Labour substitution+I140 petition in June 2007. This got approved in November 2007. but my H1B transfer to this company is still not approved. Earlier this year (2008) I went back to my previous company whose H1B is still valid and waited for my old H1B to get approved with no luck.
Now, i wish to start my GC process with this new company, can I retain my old priority date of I140 ? There is absolutely no chance that I will get I-140 approval copy from my old employer, but I have the receipt Number and I know the PD.

Any help is appreciated.

Hi,

I am transfering my H1b to my friends company. And I have to bear all fees. As such my case is simple, no complications. I have good education credentials and 10+ years of exp. Got education evaluation also with me.

I just went thru USCIS site and it looks like to me that filing H1 transfer by myself (or by my friend) is a fair simple job.

Can anybody give me advice or have some experiece in filing H1 or transfer H1?

I guess that should be OK. Only H1B rules require one to be continuously earning. On EAD, if you have a potential employer who is willing to hire you after your GC is approved, you can remain without regular paychecks.

I know of the guys, who actually availed unemployment benefits on EAD, and yet got their GCs. At least sitting without regular paychecks is better than that.

It is a security check as part of 485 processing where you are checked for a criminal background.

I am planning to go for visa stamping soon. This will be by 7th year extension. I have the following questions. Thanks for reading my post and for replies.

1) Recently my title changed from "member of technical staff" to "senior member of technical staff" and I got a pay increase. But the job duties is the same. I don't think this needs H1 amendment. Does it ? I also hope that this will not affect the green card processing.

2) This may be a dumb question. I have the approved I-797 but the online status still shows as pending. Since I know at least one USCIS database is not updated, is there a reason to suspect PIMS delay when I go for stamping ? I am planing to go for stamping in Chennai, I assume there is no way to check beforehand. Did anyone else experience the same (online status not updated) and face any delays due to PIMS.

For my 9th year H1-B visa extension, i want to use the premium processing. All the attorney fee and any other expenses will be paid by my company. I want to pay only the $1000 for premium processing. Is this legal ? Can the attorney attach my $1000 check signed by me, to the visa extension application with all other paperwork and send it to BCIS ?

If this is not legal what are my options ?

Please let me know.

Lets say, after getting EAD and AP and 6 months after filing for I-485, you want to switch jobs to another company but want to do an H1B transfer to a similar position. Do we still have to start the green card process from scratch to remain on H1B?

Below are the 2 listed jobs.. I am currently working as ABC for XXX comp... I have been working for more than 3 years.. They are planning to file my GC soon..

I know for a fact that you cannot count current employer exp for GC. If i start working for the same employer on XYZ is it more than 50% different in role so i can count my 3 years experience when applying my GC ??

Correct me I am wrong here:

AP allows you to enter US without a valid visa.
EAD allows you to work in US for any employer.

Untill and unless someone utlizes his EAD, he is still on H1 (if he has valid H1) doesn't matter he enters US using AP. Am I correct?

Then question arrises, If H1 holder changes his job then he needs to transfer his H1 only and not use EAD. Is this possible to have H1 renewed and transfered even though one has EAD approved, meaning is it compulsory to use EAD one you get it?

I think if you can prove the emergency to the consulate then you can book an emergency appt. I assume all H1's are eligible for this appt. SEnd a mail to consulate and chekc it out.

I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.
Here is my current status :
6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :

1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?
3. If I was to apply for H1 extension in Nov and don't get an approval by the time of my current H1 expiry in December, will I be out of status?
