This evening, I watched a debate on television between a proponent and an opponent of comprehensive immigration reform (CIR). The proponent emphasized that we need CIR not for the benefit of the undocumented but because it would stimulate the American economy. The opponent said that this amounted to "open borders" and that our immigration system was already generous enough in the eyes of most Americans. The immigration system mirrors the economy, now we know it. H1B visas (http://www.h1b.biz/lawyer-attorney-1137085.html) are still available with more than 15,000 are up for grabs. The numbers are pretty much unchanged since late May.
As of August 14, 2009, approximately 45,000 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn. We will keep you posted with any changes in this area.

Hi All ,
I remember last time when PD became current USCIS did not follow the correct order /sequence of PD while allocating visa numbers .
Many of the people who had PD of 2006 got Visa number allocation before people who were in queue ahead of them with 2004/2005 PD.
This time we should have some campaign may be by sending the letter or some way to USCIS/DOS and make them aware to allocate visa based on PD in a fair and transparent way.Any suggestions ????
This opportunity has come after many many years for many of us, we should make our best effort that visa number allocation are done in a fair and transparent way for coming month and month's to come.

Hi,
My Spouse Application was rejected due to incorrect fee though the USCIS were accepting application with old fee till august 17th! It was filed on August3rd! and it was with old fee! Will it be accepted if we send a letter that the fee was right the first time!
Has anybody's both primary and spouse applications got the receipts with old FEES and had applied in AUGUST, Pls reply asap as my spouse application rejected and we had applied on august 3rd!

She can't work and you can't apply for work permit. You need to wait for the I-130 approval. Then AFTER you become a U.S. Citizen, she will be able to apply for I-485 Adjustment of Status and only at that time you will be able to apply for work permit. By the way. If the I130 is approved and she goes out of country and then tries to re-enter the U.S. on a B-2 visa, she may be denied entry based on Immigrant Intent, for which B1/B2 visa does not allow. Do some research.

I am on 8th year of my H-1B, expiring on July-2008.
I am on EB3 Nebraska, PD 07/2003.
I-140 pending � RFE on Education (3 years degree) replied on December-2007
EAD approved on September-2007.
I485 aplied on july-2-2007
Just got an email from Cris that my I485 was denied. I don�t know the reason.
My I140 is still pending � almost 4 months after my attorney replied the I140 RFE.
Today I am writing this in order to understand my available options and strategy to this situation.
I have less than 2 months on H-1(b).
What are my options?
Anybody in the same situation?

I am guessing it should be OK. if at all it needs redirection they will do it internally. besides you can check in your online case status about the RFE or call NSC if you need.

1. When NVC sends a I-864 form. is priority date to be current for this ?
2. When NVC sends a packet 3. is priority date to be current for this ?
3. what will be happen if the priority date is current and interview was scheduled in next month, and then priorty date suddenly will not be available in next month.
4. Can I track status with NVC using I-140 receipt number ?

The case speaks to several issues -- how the Bush administration deals with critics of the war in Iraq, and the games that Washington's reporters and politicians play with each other. As far as the jury is concerned, however, the case is about only one thing: lying.
One particularly well-qualified witness on this subject was not called by either the prosecution or the defense, so today we cross-examine Robert Feldman ourselves. Feldman is a social psychologist at the University of Massachusetts who studies lying in everyday life, and his findings are just the kind of thing that Libby's lawyers could have pounced on.
Feldman's experiments show that stern-faced judicial proceedings about perjury are as remote from the realities of human behavior as President Bush is from the Nobel Peace Prize. For one thing, lying plays a more complex role in human relationships than the black-and-white legal view recognizes. It is also so commonplace in everyday life that putting people on trial for lying is somewhat like putting them on trial for breathing.
Experiments have found that ordinary people tell about two lies every 10 minutes, with some people getting in as many as a dozen falsehoods in that period. More interestingly -- and Libby might see this as the silver lining if he is found guilty -- Feldman also found that liars tend to be more popular than honest people. (Ever notice how popular politicians somehow change their minds on controversial issues such as the war in Iraq at the exact moment that public opinion on those issues changes?)

If a H1B visa holder is in US, i know it is possible to transfer H1B to a different comapny in US. But can anyone help me understand if the same is possible if the person having the H1B visa is in india currently?
