1. Can a new employer apply for H1B extension based on my I-140 approval even though I am not in USA.? My I-140 has not been revoked or cancelled.
Yes, this should be possible assuming your priority date is still backlogged. If not, you can at least get the unused part of your 6 years.
2.Can I claim the remaining time on my H1B approval(based on I-140) with company XYZ ? I have copy of the H1B approval but not sure if it has been revoked.

Hi,
I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!
If I remember correctly, you are allowed to work for 240 days from the receipt date while your case is pending. If the approval does not come within 240 days, you have to stop working and wait for the approval. You are NOT considered out-of-status as long as your petition was filed before the current H1 expired.

IF at the time of applying for the H-1B, you were on a valid H4 status and H4's validity was beyond October 1, 2010 then you should have have been granted an H-1B change of status with a valid I-94. In case your H4 was not valid or you requested a consular notification, then you need to go to your home country and get visa stamp from the consulate and come back to the U.S.

I have to do a emergency travel to India and I did not get my advance during that time. I went to USCIS office in person and got the advance parole and flyed to India.
Back in US I learnt from my wife that I got another copy of Advance parole which I have applied earlier. Both Parole documents look different in format and the one which I got from USCIS office does not have the SRC nubmer on it.
If my wife sends the recent Advance Parole documents via FEDEX, not sure which document I should show up at port of entry..Plese help.

Both are valid Parole documents. But technically you are supposed to have the approved advance parole documents with you before you leave the country. So it would be better for you to use the one you got from the USCIS office for this trip.

Bush said he wants to improve the working visas, I think the prority needs to offer to Canadians because Canadinas use the same language and education system, the distance is closer. We need to call all the senetors, the working visas.etc. need to go to Canadina citizens first.

Thanks in advance for answering my question:
I have had an EAD from past 2 years, but I also had a valid H1B I was working for company A on H1 and my GC is filed by Company B future employment(and hence the EAD)
- Company A went down last year, so I was laid off, so my H1 lapsed.
- I switched to Company B since I have an EAD through them.
- I am on Company B's payroll currently.
- The company A folks needed help after they were shutdown, I helped and was paid for hours. (doing same and similar work) but not issued a 1099...
Question - I will need to file taxes on those hours, in terms of immigration have I done anything out of ordinary here? I don't know if USCIS and IRS connecected, or I am just being paranoid here?

As you are on EAD nothing wrong is done as for as USCIS is concerned. Just add that income as self employment income you should be fine. Also you can deduct those expenses you made to earn that income.

I am in NJ and my current H1b expires on Nov 2008. My DL expires on Set 2008 . I was under impression that I need atleast 6 months or more valid visa to get licence.
Company didnot agree to file premium process for H1b. They are saying I have plenty of time and they will apply in Aug . I and we know that now a days it takes more than 3-4 months to get visa.
Is there a way I can get temporary lic in Nj. lawer was saying I can request 3 month temp lic beased on Notice received from CIS. Is that true ? does any one gone through same in NJ ?

I entered US with a tourist visa in California. Months later, I got married to a US citizen in Austin,Texas. Me and my husband were apprehensive at first to get an immigration lawyer to process my visa but we realized the process of obtaining a visa was not as straight forward as we thought.
We have since decided to hire a lawyer and have met with two attorneys so far. The process is frustrating because of the requirement to pay a consultation fee; we schedule an appointment, meet, and find out that the cost of hiring the lawyer is far greater than what we can afford.
My question is: does anyone know of a good lawyer who charges a reasonable flat fee? $1000 - $1500?

Hey guys,
i just picked this puppy, i ws either thinkin canon s400/500 or sony T1, i know the quality of the pics of canon are superb, but from experience of SONY camera and the size size of t1 just blown me away.
anyway, i know that there are many features, which initially are not easy to use and it takes time, but once you learn the feature,s its phenomenal!
my question was, for INDOOR use, what is the best mode to use? i tried with auto, but thigns come out blurry when there are movigng objects, or people in my case, i try to use the sports mode, but then it comes out really dark. is tehre any other mode or anythgin else i can adjust in auto mode to take nice still pictures for moving objects indoor with decent flash?

How long is the typical wait? while applying, is it true that my wife can't enter the US?

On your I-485 approval, H4 status is lost and no longer valid.
Incorrect!
If the person is out of country while on H1/H4 and I-485 is approved, he/she can enter USA on valid H1/H4 visa stamp and will be offered Deferred Inspection. In most cases, they have to report within 7-14 days to local USCIS for passport stamping.
I suggest that you get more details about Deferred Inspection with your attorney.
