I received a RFE of my I485, and was asked to declare my self-employment since Dec,31, 2006. I have been engaged in Market America Direct Sell business part-time since August 26, 2005, and have claimed buinsess lost in my tax return since 2005. In 2006, I got a 1099 form that showed $600 income from Market America. After that I didn't have any income from the business.

My question is if I am self-employment. If so, do you have any way to resolve this issue?

My last entry into USA is 07/05/2008, but the I-94 was not replaced at Niagara Falls port. The last entry date on my passport is still Dec, 31, 2006.

My EAD start date is 7/31/2008.

I am looking for an Attorney who is an expert at this case to reply my RFE and resolve my pronblem.

My and my family I-140 is approved. Based upon this approval I got three years H1B visa extension too. By the way this is my 13th year in the USA.

As a plan B, if I move my family to Canada, as we have Canadian residency, to continue their lives there. And in the mean time say after 1 year of their going there, say here in the USA our priority dates become current. At such a juncture will there be any way that I delay filing their I485 so they may get their Canada citizenship without creating any conflict between US and Canada residency status.

Hi -

I got my I-140 approved back in 2008 and last year my H1b was extended for another 3 years.
I am planning to change job now and once the new company transfers my H1b will it be extended for another 3 years or for the remaining duration of my current H1B.

Also what happens if my current employer revoke the I-140 after i change job?
Until when can i start the GC process with new company so that i don't go out of status and keep getting extensions until i get my GC?

Hi,

I got RFE on Advance Parole requesting proof that I have complied with NSEERS.

All I know is I went for Special Registeration back in 2003 when it initially started and citizens of specific countries were required to go for that special registeration. The immigration officer stamped my I-94 and wrote a FIN# on my passport and I-94.

Last time I travelled out of US was back in May 2001 for couple of weeks.

Now got this RFE any idea what do I need to submit.

Hi Friends,

As the Visa Dates are current, I want to file my 485 on July1st. Can I file the 485 for my wife and son at a later date(because they are travelling to india on june 16th and will be back on September 1st) or Is it a must that all of three(myself,wife,son) should file for 485 at the same time.

Can I add their names to my 485 later.?
Currently My wife and son(6years old) are on h4.

Hello?

In Mid 2007, 7th year of H-1B transfer & extension was filed, and was no problem as I had an approved ETA-750 with ex-employer, but it was expired soon as the sponsor�s (ex-employer) company was closed at the end of 2007.
The 7th year approval period was 12/11/2007 ~ 12/10/2008 with the current employer.

I filed another labor certification (ETA-9089) on 10/23/2007 which was sponsored by my current employer, and it has not been approved yet.
Using this ETA-9089 pending more than 365 days, I filed an I-129 extension for 8th year of H1B last November 2008, but INS sent "Request For additional Evidence Sent" letter which was saying to be provided �An evidence of pending / being processed for more than 365 days of labor certification or I-140 prior to 6 year expired of H-1B�. we just realized that a memo was posted regarding this on 05/30/2008.

As I don�t have this evidence... Please advise or recommend me...

Scenario:

Working on H1. Wife is on H4. Waiting for our EADs.
Planning to work for H1-GC sponsorer employer until (or I should say 6 months after) we get the GC.

I am running a website and am planning to sell the advertising space?

Q1: Can a H1 legally receive the money from website advertising on his/her website?

Q2: Can a H1 register DBA?

Q3: How about if H1 uses EAD, can then he register DBA and legally receive the money from website advertising? (I know once you use EAD your H1 becomes invalid).

Q4: I know I can register DBA in wife's name when she receive EAD? Is that the only option I have?

Please share your thoughts!

* Is it get H1 visa and not join the company that has filed for my H1?

* Can I legally continue with my current company even after I get my H1?

* Can I join a third company instead of joining the company that has filed for my H1?

Once you start working as a trainer, you have violated H-1B status so that you must rely on the EAD for both the gym job and the Systems Analyst position. You must also use Advance Parole, not the H-1B visa, to return after travel.

Will there be any updates on 485 LUDs when USCIS works on I-140?

I have submitted approved EB3 I140 and 485 on Aug 2nd 2007. I submitted EB2 I140 for approval on Dec 11 2007. There haven't been many LUDs on any of these files except when applied for AP and EAD. Now on Apr 7th 2009 I see new LUDs on EB2 I140 and 485(for both wife and me). There is nothing after that. I am not able to make out anything of it. Any comments, suggestions or opinions are appreciated. Thx

i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
i would appreciate it if i could get an answer soon so that i could take the semester off.
