    thanks for the reply. but she cannot wait for the i539 to be processed as it is taking more than 1 year for that. She cannot wait that long. Is there anyway to transfer unveirstiy with pening i539.

    If not, then what is the way to cancel this i539. We do not want to send her outside the country.

    I am not using Silverlight, just using Visual Studio 2005....
    I use Response.Redirect("previous_page.aspx");
    this make the page load again so cannot display back the previous view...
    There is really no other methods in C# without javacript?

But wait, Americans are already saying that.

    So, Senator Ensign, good for you, you did not break the law in Nevada by committing adultery and cheating on your wife. However, you have sacrificed the "moral high ground" you may have thought you once had. And while your wife is apparently is willing to forgive you, frankly, I doubt anyone else is.     Today, my friend told me that there is new policy prohibiting employees from paying the H1B application fees for their employers. Has someone heard about this policy? If so, would you please provide me some more details on the issue? Where could I find the policy?

    I have got two offers. Both the employers are willing to help me apply for H1B, but I need to pay all the fees by myself. I think that is ok for me. But under this new policy, I am not sure whether this strategy would work out or not. I really very worry about this issue. Your kindly help is highly appreciated!! Million thanks!

    Prohibiting employees from paying the H1B application fees is not a new policy. It has always been there.

    However there is a new policy prohibiting employees from paying Labor related expenses in GC process.

    Hi, I am a holder G4 visa working on a international institution in Washington DC, USA...and my fiance is a G4 visa holder too, working on other international institution in the same city (we are foreigners, south americans, especifically)...ok...the main issue is that we want to get married next month in USA and sure as G4 visa holders at that time....but on this September, my fiance is going to change his status to a F1 visa, because he is going to pursue his PHD on a US University....and I cannot change my status as dependent of him (F1 dependant), cuz I need to keep working, and I dont know if it is necessary for studying here to have exclusively F1 visa as a foreigner student, or he could become a G4 visa dependant from me, after he stop working to start studying.


    ...So my question is if we get married before that he changes his status from G4 to F1...would I be able to keep working on any international institution meanwhile he can keep his F1 student visa?, with no need to become a dependent from each other, but to keep, my G4 visa, and his future F1 visa, respectively?

    My doubt is based on one comment that i heard from someone, but i am not sure, cuz that person told me, that if my husband changes his visa from G4, resigning my G4 dependent status, i couldn't be rehired later...i tried to get advide from a lawyer but his service is so expensive for me...so i hope someone can help me, cuz this issue is so important for us.

    Ps: For more information, my fiancee would have to go to his country and getting his F1 visa and go back to USA as a F1 visa holder....And before that trip...we would like to get married...and meanwhile he is studying with his F1 visa, I can work with no problems with my G4 visa rehired as many times as I am re hired...

    My wife has recently got a F1 visa (and her H4 visa has been left valid).
    I am applying for I140. Is it ok to mention her name on my I140 as my spouse?

    In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.

    Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.

    You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

    I recently came back from India, and got a new I-94 at port of entry, but later I noticed that CBP officer added 10 more days to my I-94 expiry(it may be a mistake by the officer)

    Do I need to worry about this? any advice/suggetion?

    I am almost at the same situation.I have been here for since July 2000.Instead of getting married for american citizen I decided to go the long way.I have been changing visas from B2-H2b-F1 and now recently I apply with I140/I485.After having Masters degree in civil engineering from my country I went to school to become a nurse.After 3 years and many school I did finished and I passed the National exam for nurses but just when I was about to file for Schedule A the visa number finished and there was no chance of getting new once.Thank god they open the EB3 in July,or so I was thinking.USCIS did not separated my I140 from I 485 so I had no answer for 5.5 months.Only after I ask senators for help the thigs started moving.Finnaly I got my EAD and I can go back to saving life,which by the way I love.My advice is to marry US citized ASAP.Will save you a lot of trouble and if you love that person even better.;)

    On June 1, 2009, new document requirements go into effect at land and sea ports for entry into the United States. Pursuant to the Western Hemisphere Travel Initiative ("WHTI") an individual may show one of the following documents in order to be admitted into the United States:

    U.S. or Canadian passport;
    Trusted Traveler Card (Nexus, Sentri, or Fast/Express);
    U.S. passport card;
    State or province issued enhanced driver's license.


    California does not issue "enhanced driver's licenses." (Enhanced driver's licenses contain multiple levels of security features.) It is no longer possible after June 1, to travel to Canada and expect to return with just a California driver's license. You must therefore have proof of citizenship as indicated above or proof of lawful permanent residence (i.e., "green card"), or proof of some other kind of non-immigrant status in order to be able to return to the United States.

    Please do understand that we do not want to have any post that offend other people. Otherwise the lawmaker's staff and the media folks who visit our forums, will assume that our organization and members stand for such a stance.

    Hi,

    I will be grateful if anyone can give me advice about this situation:

    I was on H1B for company A. I got an offer from company B last week and I just visit POE to get the TN visa

    with new I-94 card. My TN support letter and offer letter clearly state my first date for company B is

    09/07/2010, that is, 2 weeks from now.

    The problem is that I assumed I could still work for company A(my H1B sponsor) for another two weeks, so, I

    planned to let my employer know the coming Monday, to fulfill my 2 weeks notice advance promise in the next

    two-week time. However, I heard that my H1B would be void as soon as I got my TN visa, is that true?

    That is, will the status change(from H1B to TN) start from the time I got the TN visa at POE(09/22/2010),

    or from the time I start my new work for company B on 09/07/2010? Is the H1B visa still valid for me to

    work for company A for another two weeks before I start my new work?

    If my H1B visa really became invalid at this time, I will have to tell my manager at company A the true and

    appologize for that, although I feel very bad about that. If not, I worry I would be caught by the

    government and charged for illegally work for two weeks, then I will be in big troubleshoot for further

    immigration petitions(TN, H1B, even GC, etc.).

    Please advise and if possible, please provide references with which I could show my H1B sponsor/employer.
