Few friends of my whose PD were in 2003 had got their GC no matter the current opening is for Jul2001, since you have already applied for ur I-485, I think it would be better for you to wait & watch for some more time and join company B on EAD with contract to hire position.
Or else you can start ur EB2 processing also through Company B and then later I think there is a way to make us of PD of EB3 when filling for ur I485.

WASHINGTON - Senate Republicans and Democrats closed in on a last-minute compromise Thursday on legislation opening the way to legal status and eventual citizenship for many of the 11 million immigrants living in the United States illegally.
Sen. John McCain, R-Ariz., said he had been assured President Bush supports the measure, and would publicly say so later in the day.
As outlined, the measure would provide for enhanced border security, regulate the future flow of immigrants into the United States and offer legalized status to the millions of men, women and children in the country unlawfully.
"We've had a huge breakthrough" overnight, said Majority Leader Bill Frist, R-Tenn.

Sen. Harry Reid of Nevada, the Democratic leader, agreed, but cautioned that the agreement had not yet been sealed.
Even so, the presence of both leaders at a celebratory news conference underlined the expectation that the Senate could pass the most sweeping immigration bill in two decades, and act before leaving on a long vacation at the end of the week.
The developments marked a turnaround from Wednesday, when it appeared negotiations had faltered. The key sticking point involved the 11 million illegal immigrants in the country, and the struggle to provide them an opportunity to gain legal status without exposing lawmakers to the political charge that they were advocating amnesty for lawbreakers.
While final details were not available, in general, the compromise would require illegal immigrants who have been in the United States between two years and five years to return to their home country briefly, then re-enter as temporary workers. They could then begin a process of seeking citizenship.
Illegal immigrants here longer than five years would not be required to return home; those in the country less than two years would be required to leave without assurances of returning, and take their place in line with others seeking entry papers.

I am also waiting on the dates to open in December. The dates are not available on the internet as yet. I think they open the dates for 1 week every week .. so you can only book a month in advance.

I-94 determines your status in US and visa stamp is a merely used to enter into US .hence make sure your I-94 is stamped till the expiry date of new I-797 otherwise you would get into issues.

In the past week or so we have been receiving many requests for evidence on all H1b cases filed on April 1, 2009. The RFEs received by us and practitioners across the country so far appear to only request that the single page of the I-129 Data Collection sheet be sent with the TARP question answered.
Due to the passage of EAWA, USCIS is required to collect TARP (and Section 13 funding) information on each H-1B petitioner. However, by the time the new form became available, we had already completed our packages for the H-1B cap filing period for April 1, 2009. Therefore, USCIS confirmed that the new I-129 form was not mandatory and that only the one page (of the I-129 Data collection sheet requesting the TARP information) was urged to be included.
At the AILA Spring Conference in Washington, D.C., Barbara Velarde, Chief, USCIS Service Center Operations, mentioned that if the TARP information was not included in the filing, the petitions would not be rejected. However, USCIS would need to send an RFE for the TARP information. Unfortunately, this was not clearly explained in the USCIS fact sheet on TARP issued on March 20, 2009. Nevertheless, USCIS is required under the EAWA statute to obtain this information and the easiest way for USCIS to comply is to send an RFE. This is a very annoying and time consuming process for all us dealing with H1B filings, and even more confusing for the clients. We hope that USCIS explain better such crucial changes in future matters.

help filing EAD AND AP after rejection

My EAD and AP application got rejected because of missing signature on the form.Now i am planning to file on my own with out the help of attorney as he is charging me too much for refile.
So needed help in drafting the letter addressing the situation.Above all i didn't receive my application back and USCIS personnel told me that i can refile as a fresh application if i don't receive in 30days.And i am already completed the 30days.I do have the rejected application LIN number and my 485 receipt.
Please advice me what to do i want to avoid attorney.

I am planning on accepting a full time position at client.I did not start with them yet. Client's lawyer is planning on applying for the PERM application and recruitment has already finished. My question is
Since I am yet to join the client, should the question in PERM application "Has the job been offered to foreign national " be set to Yes or No. Clients lawyer says we can leave it as "No"(Since I did not start with them yet) but chances of getting Denial because of this question are high. Should I join the client and then file for PERM or Is it OK to set it as "No" and hope it will get approved.I am planning on joining the client in couple of months.

Dear Fellas,
I went for H1b Stamping a couple of months back. I was given a 221 g at that time and later on was asked for company's tax documents. During this time I did not hear any thing from US embassy in islamabad and got the same reply that my case was under administrative processing.
yesterday I received a letter from US embassy saying that my petition was returned to INS. The whole process has been very frustrating and I even left a couple of good offers hoping that H1b will get through anyways I guess its over for me now......
Did any one else face the same situation?? Will it do any good to reapply?

Sorry to hear about it. Don't get discouraged though, you will find new offers soon, just keep trying. Remember that persistence creates luck. About the reapplying for visa, I guess you should first talk to your company about it and then with the lawyers who helped prepare the documents. I guess, that'd be good place to start with. In the mean time, keep an eye on the opportunities in your home country. Good luck.
