Fellows,
some body told me that if you are on H1B1 then you can not file for greencard. is it true?
I am on H1B1 and I have approved I-140.
I didnt knew the difference between H1b and H1B1.
Please help, I am so frustrated.

I think India must ask US to send back all the skilled H1b holders exactly after 6 years and not issue GC. Then you would be surprised to see heck of a lot approvals !!!!

I am almost at the same situation.I have been here for since July 2000.Instead of getting married for american citizen I decided to go the long way.I have been changing visas from B2-H2b-F1 and now recently I apply with I140/I485.After having Masters degree in civil engineering from my country I went to school to become a nurse.After 3 years and many school I did finished and I passed the National exam for nurses but just when I was about to file for Schedule A the visa number finished and there was no chance of getting new once.Thank god they open the EB3 in July,or so I was thinking.USCIS did not separated my I140 from I 485 so I had no answer for 5.5 months.Only after I ask senators for help the thigs started moving.Finnaly I got my EAD and I can go back to saving life,which by the way I love.My advice is to marry US citized ASAP.Will save you a lot of trouble and if you love that person even better.;)

Yeah. Same here. Very disappointing to see 2006 cases being approved immediately after dates got current instead of the 2004/2005 cases.

Hello all,
My EAD expired in late April
Prior to that, I applied for renewal but my old lawyer forgot to either include something with the application or made a typo, and it bounced back a few days ago (late May).
I got a new laywer to re-file the EAD, however I will not get my new one in time to start my post-college job in early July, as the process takes around 90 days from what I remember.
If I show up to the first day with a filing receipt, a written letter from the new lawyer explaining what happened, and my old EAD, will I not get the job?
How do employers handle something like this?

true but is you ever want to come again on B1 return as soon as possible.
you got a stamp of 6 months stamp of 5.5 ..
to get a longer stamp next time try not to stay even the full 5.5 months

Mine is NSC to CSC
Till today No FP
Finally today Mar 18 I got a mail saying
Application Type: I140 , IMMIGRANT PETITION FOR ALIEN WORKER
Current Status: Case Transfered to Another Office for Processing
So now on what basis date, RD Aug 22 or transfer date Mar 18 they will touch my case .How long will it take ? Any body on same boat.....

hi,
I am planning to extend the visitor visa for my mom for another two months.
Her current I94 expires on June 25th and At POE the officer told her that she must go back after 6 months.
If I apply for extension of her visa and in case she does not get any result before current I-94 expiry date, is it wise to stay on or leave US in order to avoid overstays?
2.What happens if she gets a rejection before her current I94 expiry, will she need leave earlier and apply for new visitor visa?

My roommate is from England. She applied for a work visa, I'm not sure which number or letter, but anyway she was supposed to apply 90 days before her studies ended up to 60 days after. She mistakenly sent the application in 94 days before she finished her studies and they denied it because of that.
I read the form and it said there is no appeal. She went to try and take care of it today and they told her not only is there no appeal, she can never apply again. Is that really right? For a simple mailing error she can't ever get a work visa now?
What other options does she have?

Today my lawyer sent me my receipt numbers for 485, EAD and AP. when I enter my AP receipt number to check online status I see the following...
Application Type: OS155A, IMMIGRANT VISA AND ALIEN REGISTRATION
Current Status: Card production ordered.
On August 30, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
Anyone know what this means... It doesn't say I-131 in application type..
Second disturbing thing I noticed when I entered my 485 number...
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Fingerprint fee rejected and notice mailed; case in suspense.
On August 23, 2007, we rejected your fingerprint fee and mailed you instructions for how to submit the necessary payment. This case is now in suspense. Please submit your payment with our notice as soon as possible after you receive our notice so we may resume processing of this case.
My lawyer says the checks have been cashed and we have proof of this.. She says it can be a typo..
Most weird part is for my EAD it says card has been ordered.. but I haven't even done finger prints and my 485 is in suspense..

It is not just enough for you to have the qualifications for EB2. The job requirements also should have that requirements. So in the PERM application - the job requirements has to be specified. I think the lawyer messed up the PERM process

My 6th year of H1b is expiring in the Sep 26, 2008. I already applied for my H1b renewal and already got the receipt. I'm Eb3 - ROW.
My and my wife also applied for our EAD renewal in jun 1, 2008 (Nabraska). didn't receive anything till now. My wife needs that to continue with her job, we already expedite the process last week.
I also visited home couple of months and and entered Us using my AP.
I have some question regarding all those issues:
1) Can I get a business license when i'm working with the H1b and have the EAD?
2) Does it going to have any effect on my green card process or H1b status?
3) If i have the problem then can i open the business license under my wife's name as she will be in the EAD.
4) My PD is May 2006. Any chance it will be current in next 6 months?
Please give your feedbacks with your expertise guys. it's been very help for long time for me. Thanks ahead

We are indian nationals living in the US - I have an H1-B visa with visa stamp valid till 05/2010 and my wife is on H4 - she has a valid 797 but does not have a visa stamp yet
We are planning to visit UK on visitor visa for 2 weeks .. Is it possible to get a visa stamp in London US consulate and how long does it normally take to get a visas stamp?
