If this has happened to you personally then you may be able to let Ombudsman know about it.
if it has happened to a friend of yours then maybe you can convince the friend to complain to Ombudsman.
Beyond this I doubt there is much that can be done.

There is no FIFO system.. whatever gets picked out of the DUMP gets processed.. I don't think one can draw any conlcusion based on approvals..

I enter US four times this year by using AP, same airport, but different experience. 1st, 2nd and 3rd entry was sent to secondary check. But the 4th entry, the CBP said it's unnecessary for secondary check and fill new I-94 because previous officers are new guys, don't know the rule. I thought 1st entry is definitely need go secondary check.

Usually change-of-status applications are considered abaondoned if one leaves the country but not extension-of-status. I do not see any problems with their travel here. Gurus?

My sister in India may be getting married to a US citizen..she would like to apply for a tourist visa first so she can come stay in the US and spend some time with him before her marriage.
If she applies for a tourist visa, stays in the US for a month or so and then later they apply together for a fiance/K3 visa, are there going to be problems for the K3 visa application considering that she had just applied for a tourist visa before? Is it better to not apply for the tourist visa in this case? Thanks...

Thsi is the way otherwise if you follow the other wise (round about way) Declare intent and get GC at Consulate...USCIS will start giving you a hard time with with rampany misuse of 221(g) enquiry etc. That is the beauty: At consulate they have unchallenged powers and they know it and therefore abuse it; But once you enter USA ...if they give you a hard time, you can haul their a**es to court and

If you ram into US with a B1/B2...then great they will made deal with you...however one thing
be careful about...if the marriage is soon after you enter US and can complain of the false intent in the B2 entry...

My h1 extension is under process. Once it gets approved can I am thinking of going to canada and get it stamped. My wife has also applied for cos from h1 to h4. It was not applied with my h1 extension but was applied 1 month later.
My question-
Can we go for h1 stamping for myself(once approved) and h4 stamping for my wife , even though her h4 is pending.Would I-539 receipt notice would suffice .

Guys,
I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

I am not aware of any required time while in adjustment of status. There is on GC but not in AOS pending

There is nothing like losing. If it expires, you will have to renew it.

This will be a new H1 application since you never used the original one. You will need to go to the US Consulate with the new approved H1 document and they will ask you why u forsook the first one....
