My understanding is that you can transfer existing H1B. I am not a lawyer.If you have a copy of your H1B approval notice, you should be able to transfer to your new company. However, if you may have to visit US consulate back in your home country for Visa. You may want to double check with immigration gurus.

On 28 November 2008, "the United States" as defined for purposes of the Immigration & Nationality Act (INA) just got bigger, with the addition of the Commonwealth of the Northern Mariana Islands. Although there are probably wrinkles I have not yet read in the treaty, this essentially puts the CNMI on the same footing as Puerto Rico. Here's the cute part:
Because the CNMI will become part of the "United States" as defined by �101(a)(38) of the INA, "residence or presence in the CNMI before 28 November 2009 shall NOT be considered residence or physical presence within the USA for INA purposes. Thus, on 29 November 2009, all persons physically present in the CNMI are considered "to be present in the United States without inspection, by operation of law."
Will these PWIs (present without inspection) be eligible to adjust status? Unclear? Are they working "abroad" for purposes of L visas? Yes, as it turns out. One thing is clear: Legal Permanent Residents (so-called "green" card holders) who wish to base a naturalization application based on physical presence in the CNMI will NOT be able to do so for pre-29 November 2009 periods of time. I want to keep this thread on top for a while to see how many People with priority date between Jan'05 and March 28th '05(Filed under RIR/NON-RIR) applied again in PERM. The reason is lot of Friends i know applied their labor again in PERM since the Old Labors filed under RIR were sent to BEC Center's in Phily and Dallas for 'cold storage' and forgot to port the dates after the old labor approval since the time regained was not big enough.
This gives us an fairly good idea to see how quickly the dates would move from Jan' 22nd '05 as many fear there might a huge figure here who applied between December '04 and March 28th '05 under the old process and before PERM kicked in .
Please do not forget to mention if you have ported the dates from your old labor.

There is always an ad for rain gear in the back of photo mags by this one company...I can't think of their name at the moment but I'll find it when I get home. Stuff looks pretty neat.
I've seen those ads, but wonder how effective the products are. I bought one after seeing it in an add and it fits perfect with my 300 but with smaller lenses it's to big. I was hoping I might hear from someone who has one for a smaller lense (17-80 ish).

IV seems to have a lot of folks here on a h1b with a non profit organization. My wife is currently doing her residency in a non profit organization on a h1b so basically she is not subject to the cap.
After she finishes, and she looks for jobs, is it possible to get a h1b transfer in a profit organization without being subject to cap? Or H1b transfer is possible only with an non profit organization.
Any inputs will be well appreciated.

Is AC21 relevant at all for NIW applicants? It can not be as there are no employers filing for such people. However is there anything related to that for such applicants?
Can't they change job or use EAD for whatever job they want to take?
Should the new job be exactly the same type of job?
If an NIW applicant loses job, will that be a problem?
When USCIS is going to know/check on what job the applicant is currently working? Is this going to happen at the I-140 approval stage or I-485 stage or when somebody applies for Citizenship?
Any NIW applicants around here in IV?

I am trying to file Labour under EB2 with Bachelors and 5+ year experience. My HR manager told me that filing this requires "all the other employees in my company with the same title should have a bachelor degree". She also concerned about having "Bachelor degree" as mandatory for future recruitements for the same title.
Please throw some light on this.
Not sure if this applies to ALL the other employees or just the ones in your group. I was in a similar situation and my HR said only my group matters. I have Bachelors with 5+ years of experience and my position also requires min 5 years. My EB-2 was approved last year.

I was recently invited by a fellow worker, who is spanish ( I am desi ) - to an event organized by CHIRLA - the Los angeles (http://www.chirla.org/) - Colation of Humane Immigrant Rights of Los Angeles. It was a fund raiser - with Fun, a few bigwigs were also present and people were paying $100/person to enter. Although this was a glitzy function with girls in gowns and guys dressed up in party wear..with drinks and lights etc..the gathering was all spanish, and there were many families as well as lot of college kind / working youth were there...
This gave me an idea about IV and how IV is now a known organization, both within the immigrant community and now also in the USCIS as well as with lawmakers and AILA, how about organizing a fund raiser in DC - invite AILA, maybe Rajiv Khanna and maybe someone from the CIS community. It can be a good platform both for IV to make an impact as well as generating funds and interest in what IV is doing.
Maybe have these people spend 10 minutes each on the stage, with some good grub (sponsors can be approached) and maybe light drinks (not sure) - but all in all a nice atmosphere and a forum to help us not fight with USCIS but to make them understand and appreciate our pain.
I know we have done this in college and all, but a 10 minute short play by the Immigrant community (DESIS) - should be fun as well as an eye opener to these guys..
Guys, don't shoot me down..its just my humble suggestion, however if you guys think differently I am fine with it. I just expressed what I felt but it is for everybody to decide.

In the US, attorney ethics rules vary somewhat from state to state. In most states, you are clearly entitled to all substantive materials contained in your case file. Unless the retainer/fee agreement clearly obligates you to pay for copying costs in this circumstance, the law firm should give you the documents you want without charge.

most employers dont file EAD or AP - (if the beneficiary is on H1)

I dont think this is going to affect non immigrant community (read as H1s, GC etc). This is all about politics to gain the support of rich and influential Indian American community for the DNC and upcoming elections.
This is what politicians do, be it the US or India or any place on earth. BHO is one of them, isnt he? :cool:

Guys/Gals,
Do you know that if i become a named Plaintiff in 485 fiasco lawsuit and the lawsuit drags for a Year ( just vague timeline) does that imapairs my ability to file a fresh new 485 application if my PD becomes CURRENT ?
I'm also assuming that USCIS would not return my Package sent on July 2nd since i'm the middle of a live lawsuit as a plaintiff.
Thoughts ? Knowledges ?
